6. Product Availability

All Products are subject to availability.

We may display a Product as available when stock is limited.

If a Product becomes unavailable after an Order is placed, we will contact the Customer and provide an appropriate solution in accordance with applicable law, which may include cancellation and refund where required.

7. Prices

To place an Order, the Customer generally needs to:

  2. Select available options such as flavour or quantity;
  3. Add the Product to the shopping cart;
  4. Review the shopping cart;
  5. Enter the required billing and delivery information;
  6. Select a delivery method;
  7. Select a payment method;
  8. Review the Order;
  9. Confirm the Order with the applicable payment obligation.

The Customer is responsible for checking the Order details before submitting it.

For online contracts that create an obligation to pay, Polish consumer law requires the Customer to receive clear information concerning the payment obligation and the order button or equivalent function must clearly indicate that placing the order involves an obligation to pay.

10. Order Confirmation

After an Order is submitted, we may send an Order confirmation to the email address provided by the Customer.

An Order confirmation may contain:

  • Order number;
  • Products purchased;
  • Quantities;
  • Prices;
  • Delivery information;
  • Payment information;
  • Other relevant transaction details.

The electronic confirmation does not remove any mandatory consumer rights.

11. Formation of the Sales Contract

The purchase contract is concluded in accordance with the applicable law and the ordering process presented on the Website.

The Customer will receive confirmation of the relevant transaction on a durable medium, such as email, within the legally required timeframe.

Polish consumer law requires relevant pre-contract information to be provided clearly and, for distance contracts, confirmation of the contract to be provided on a durable medium.

12. Payment

We may offer one or more payment methods through third-party payment providers.

Available payment methods will be displayed during checkout.

Depending on the selected payment method, payment may be processed by a third-party payment provider.

KROX LABZ does not intentionally store complete payment-card details unless such processing is specifically required and lawfully supported.

A payment provider may have its own terms and privacy policy.

13. Delivery

Products will be delivered to the address provided by the Customer during checkout.

Available delivery methods, estimated delivery times and delivery charges will be displayed before the Order is submitted.

Delivery times may vary depending on:

  • Delivery destination;
  • Selected courier;
  • Product availability;
  • Payment processing;
  • Public holidays;
  • Circumstances outside our reasonable control.

We will comply with applicable statutory delivery requirements.

14. Delivery Address

The Customer is responsible for providing an accurate delivery address.

If an Order cannot be delivered because incorrect or incomplete information was provided by the Customer, we may contact the Customer to arrange an appropriate solution.

Any additional delivery costs resulting from incorrect information may be charged where legally permitted.

15. Inspection Upon Delivery

Customers are encouraged to inspect the external condition of their parcel upon delivery.

If the parcel appears damaged, we recommend:

  • Photographing the parcel;
  • Recording the condition of the package;
  • Recording an unboxing video;
  • Keeping the original packaging;
  • Contacting KROX LABZ as soon as possible.

An unboxing video is strongly recommended as supporting evidence but is not intended to remove mandatory statutory consumer rights.

16. Wrong Product

If you receive a Product different from the one ordered, contact us as soon as possible.

Please provide:

  • Order number;
  • Product received;
  • Photograph of the Product;
  • Product label;
  • Shipping label;
  • Unboxing video, if available.

Do not consume or use the incorrect Product while the matter is being investigated.

Where the wrong Product was supplied, KROX LABZ will provide the remedy required by applicable law.

17. Damaged Products

If a Product arrives damaged, contact us as soon as possible.

Please provide:

  • Order number;
  • Description of the damage;
  • Photographs;
  • Photographs of the packaging;
  • Photograph of the shipping label;
  • Unboxing video, if available.

Please retain the Product and packaging until the claim has been resolved.

The detailed procedure is described in our Refund and Returns Policy.

18. Consumer Right of Withdrawal

For distance contracts concluded online, consumers generally have a statutory 14-day right of withdrawal, subject to exceptions provided by law. For a single Product, the period generally begins when the consumer or a person designated by the consumer receives the Product.

The Customer does not generally need to provide a reason for exercising the statutory right of withdrawal.

To exercise the right, the Customer should submit a clear statement to:

Email: [CUSTOMER SERVICE EMAIL]

Address: [RETURN ADDRESS]

The Customer should then return the Product in accordance with the applicable legal requirements and our return instructions.

19. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply in certain circumstances specified by law.

This may include certain Products delivered in sealed packaging where the packaging has been opened and returning the Product is not possible for health-protection or hygiene reasons, where the statutory conditions for the exception are met.

Because KROX LABZ sells sealed sports-nutrition Products, Customers should not open or consume a sealed Product if they intend to exercise a statutory right of withdrawal, where such an exception may apply.

This provision does not remove statutory rights relating to Products that are defective, damaged or not in conformity with the contract.

20. Return of Products

Where a Customer validly exercises a statutory right of withdrawal, the Customer should return the Product without undue delay and generally no later than 14 days after communicating the withdrawal decision.

Products should be packaged appropriately to prevent damage during return.

The Customer may be responsible for direct return costs where applicable and where the law permits this.

The Customer may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product, subject to applicable law.

21. Refunds

Where a refund is required, KROX LABZ will process the refund in accordance with applicable law.

For statutory withdrawal, the refund generally includes the amount paid for the Product and the standard delivery cost required by law.

If the Customer selected a more expensive delivery option than the least expensive standard delivery option offered, the additional cost may not be refundable where permitted by law.

The refund will generally be made using the same payment method used for the original transaction unless another method is agreed or legally permitted.

22. Product Complaints and Non-Conformity

Consumers have statutory rights where a Product is not in conformity with the contract.

Depending on the circumstances and applicable law, available remedies may include:

  • Repair;
  • Replacement;
  • Price reduction;
  • Withdrawal from the contract.

The appropriate remedy will depend on the nature of the problem and applicable legal requirements.

Polish consumer guidance confirms statutory remedies for goods that are not in conformity with the contract.

Nothing in these Terms limits those mandatory rights.

23. How to Submit a Complaint

Complaints may be submitted by contacting:

Email: [CUSTOMER SERVICE EMAIL]

Please include:

  • Full name;
  • Order number;
  • Product name;
  • Date of purchase;
  • Description of the issue;
  • Photographs where relevant;
  • Unboxing video where available;
  • Other information reasonably necessary to assess the complaint.

We may request additional information where reasonably necessary.

24. Refund & Returns Policy

  • Text;
  • Videos;
  • Marketing materials;
  • Other content.

You may not reproduce, distribute, modify, sell or commercially exploit Website content without appropriate authorization.

28. Product Reviews

Where the Website allows customers to submit Product reviews, reviews should reflect genuine customer experiences.

Customers must not submit:

  • False reviews;
  • Misleading reviews;
  • Reviews written on behalf of another person;
  • Reviews containing unlawful material;
  • Spam;
  • Malicious content;
  • Content that violates another person’s rights.

Where applicable, KROX LABZ may indicate how it verifies whether reviews come from consumers who purchased or used the Product.

Polish consumer rules require businesses that publish consumer reviews to provide information about whether and how they verify that reviews originate from consumers who actually used or purchased the Product.

Important: You should configure this section according to how your actual WooCommerce review system works.

29. Promotional Codes

Where promotional codes are offered:

  • Each code may have specific conditions;
  • Codes may have expiration dates;
  • Codes may apply only to selected Products;
  • Codes may not be combined unless expressly stated;
  • A code may be limited to one use per Customer.

The applicable promotional terms will be displayed with the promotion.

However, we do not guarantee uninterrupted access.

The Website may occasionally be unavailable due to:

  • Maintenance;

31. Third-Party Services

The Website may use third-party services including payment providers, courier companies, hosting providers, analytics providers and other service providers.

Those third parties may have separate terms and privacy policies.

Where appropriate, Customers should review the relevant third-party terms.

32. Links to Other Websites

The Website may contain links to third-party websites.

KROX LABZ is not responsible for the content, security or privacy practices of third-party websites.

A link does not necessarily constitute an endorsement of the third-party website.

33. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms limits mandatory consumer rights or statutory remedies.

Subject to mandatory law, KROX LABZ will not be responsible for losses resulting from circumstances outside our reasonable control.

34. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances reasonably outside our control, including:

  • War;
  • Government restrictions;
  • Strikes;
  • Transport disruptions;
  • Major technical failures;
  • Cybersecurity incidents;
  • Widespread telecommunications failures;

This does not affect mandatory consumer rights.

37. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes to our business;
  • Changes to the Website;
  • Changes to Products;
  • Changes to payment or delivery services;
  • Changes in applicable law.

The current version will be published on the Website with the applicable “Last Updated” date.

Changes will not remove mandatory rights already granted to consumers.

38. Applicable Law

These Terms are governed by the laws applicable to the relevant transaction.

Where the Customer is a consumer, nothing in these Terms is intended to deprive the Customer of mandatory consumer protections provided by the law applicable to the Customer.

For Polish consumers, mandatory protections under Polish consumer law remain applicable.

39. Dispute Resolution

We encourage Customers to contact KROX LABZ first so that we can attempt to resolve any complaint directly.

Consumers may also have access to out-of-court methods of resolving consumer disputes.

Information concerning available consumer assistance and dispute-resolution mechanisms can be obtained from the relevant consumer authorities and organizations.
